[The formation of a committee to develop procedures for building permits in the Emirate of Dubai ]

Sheikh Mohammed bin Rashid Al Maktoum has recently issued resolution No. 5 of 2020 amending certain provisions of Resolution No. 3 of 2017, regarding the formation of a committee to develop procedures for building permits in the Emirate of Dubai. The new resolution has amended Articles 2, 4, 8, 9 and 10 of the original resolution, which will be highlighted throughout this article.

Article No. 2

Under the original resolution the committee was permanent, however the amendment to Article 2 states that it will now be an interim committee.

The membership of the bodies represented in this committee has been modified, and as per in its new formation will be chaired by the assistant director general of Dubai Municipality for Engineering and Planning Sector. The committee includes representatives from the Municipality, the Roads and Transport Authority, the Dubai Electricity and Water Authority, the Dubai Civil Aviation Authority, the General Department of Dubai Civil Defense, the Dubai Development Authority and the Planning and Development Department (Trakhees). The committee members from these bodies must be selected by representatives of the bodies themselves and be experienced and specialised in the field of work of the committee.

Article No.4

Article No. (4) amended certain powers of the Committee for the Development of Construction Work Procedures in the Emirate of Dubai, which includes

1. Inventory and study of the applicable laws, requirements, conditions, and procedures regarding the provision of services related to the issuance of building works permits, and to develop these services at all stages.
2. The stages of submission and implementation, standardisation of procedures, requirements and the requirements for the provision of services related to the issuance of building works licenses in Dubai. This includes;
   1. work to reduce the duration of their provision and the procedures followed in this regard, to ensure the delivery of a distinguished service for customers in this field, and
   2. work to integrate and facilitate the procedures for providing related services to the issuance of building works licenses. This would be achieved by creating a single window for all agencies concerned and automating all related procedures, making them available through smart applications.

The Committee for the Development of Building Permits Procedures in Dubai may delegate any of its powers to any of the members of the committee or to the subcommittees or working groups formed by it, provided that such authorisation is in writing and specified.

Article No.8

Article No. 8 has been amended to include a mechanism for the committee to submit its final report to the Executive Council of Dubai before the end of December 2020. The report should include;

1. the recommendations necessary to develop the procedures for building permits,
2. the results of the committee’s work,
3. the committee’s achievements,
4. the difficulties and obstacles that it faced in practicing its tasks and achieving its goals, and
5. a proposal detailing how the committee will overcome these obstacles in the future.

This new amendment includes providing the President of the Executive Council of the Emirate of Dubai the authority to extend the mentioned deadline for the period specified by it, in the event that it is required.

Article No.9

Article No.9 specified the government agency responsible for providing financial allocations to the committee. This article entrusted Dubai Municipality with the task of providing the necessary financial allocations to enable the committee to achieve its goals and accomplish the tasks entrusted to it in accordance with the provisions of this resolution.

Article No.10

Article No.10 empowered the President of the Executive Council of the Emirate of Dubai to issue the necessary decisions to implement the provisions of this decision, and this decision is effective from the date of its issuance, and will be published in the Official Gazette.

القراراً  رقم 5 لسنة 2020 بتعديل بعض أحكام قرار تشكيل “لجنة تطوير إجراءات تراخيص أعمال البناء في دبي

أصدر صاحب السمو الشيخ محمد بن راشد آل مكتوم، نائب رئيس الدولة رئيس مجلس الوزراء، بصفته حاكماً لإمارة دبي القرار رقم (5) لسنة 2020 بتعديل بعض أحكام القرار رقم (3) لسنة 2017 بشأن تشكيل لجنة تطوير إجراءات تراخيص أعمال البناء في إمارة دبي. ونصّ القرار الجديد على استبدال نصوص المواد (2)، (4)، (8)، (9) و(10) من القرار الأصلي والتي تتعلق بتشكيل اللجنة واختصاصاتها، ورفع تقاريرها الختامية، ومخصصاتها المالية، وإصدار القرارات التنفيذية اللازمة لتنفيذ هذا القرار.

ووفقاً لنص المادة رقم (2):

تم تعديل طبيعة اللجنة لتكون لجنة مؤقتة بعد أن كانت لجنة دائمة في القرار الأصلي، كما تم تعديل عضوية الجهات الممثلة في هذه اللجنة، حيث أصبحت اللجنة في تشكيلها الجديد برئاسة مُساعِد مُدير عام بلديّة دبي لقطاع الهندسة والتخطيط، وعُضويّة مُمثِّلين عن: البلديّة، وهيئة الطُّرق والمُواصلات، وهيئة كهرباء ومياه دبي، وهيئة دبي للطيران المدني، والإدارة العامّة للدِّفاع المدني بدبي، وسُلطة دبي للتطوير، ودائرة التخطيط والتطوير (تراخيص)، على أن تتم تسمية مُمثّلي الجهات الممثلة في اللجنة من قبل مسؤولي تلك الجهات، وأن يكونوا من ذوي الخبرة والاختصاص في مجال عمل اللجنة.

فيما تضمنت المادة رقم (4):

تعديل بعض اختصاصات لجنة تطوير إجراءات تراخيص أعمال البناء في إمارة دبي، والتي تشمل: حصر ودراسة النُّظُم والمُتطلّبات والاشتراطات والإجراءات المعمول بها حاليّاً بشأن تقديم الخدمات المُتعلِّقة بإصدار تراخيص أعمال البناء، والعمل على تطوير هذه الخدمات في كافّة مراحلها، بما في ذلك مراحل التقديم والتنفيذ، وتوحيد إجراءات ومُتطلّبات واشتراطات تقديم الخدمات المُتعلِّقة بإصدار تراخيص أعمال البناء على مُستوى إمارة دبي، والعمل على تقليص مُدّة تقديمها والإجراءات المُتّبعة بشأنها، لضمان تقديم خدمة مُتميِّزة للمُتعامِلين في هذا المجال، والعمل على تكامل وتسهيل الإجراءات الخاصّة بتقديم الخدمات المُتعلِّقة بإصدار تراخيص أعمال البناء، من خلال إنشاء نافِذة واحدة لجميع الجهات المعنيّة بتقديم هذه الخدمات، وأتمتة جميع الإجراءات المُتعلِّقة بها وإتاحتِها من خلال التطبيقات الذكيّة.

ويجوز للجنة تطوير إجراءات تراخيص أعمال البناء في إمارة دبي تفويض أي من صلاحياتها لأي من أعضاء اللجنة أو للجان الفرعيّة أو فرق العمل المُشكّلة من قبلها، على أن يكون هذا التفويض خطّياً ومُحدّداً.

وتضمن النص الجديد للمادة رقم (8):

آلية رفع التقارير الختامية للجنة، حيث ترفع اللجنة إلى المجلس التنفيذي لإمارة دبي في مُدّة أقصاها نهاية شهر ديسمبر 2020 تقريراً ختاميّاً يتضمّن التوصيات اللازمة لتطوير إجراءات تراخيص أعمال البناء، ونتائج أعمال اللجنة والإنجازات التي حقّقتها، والصُّعوبات والعراقيل التي واجهتها في مُزاولة مهامِّها وتحقيق أهدافِها، والمُقترحات التي تراها مُناسِبة لتجاوز وتذليل تلك الصُّعوبات والعراقيل، كما تضمّن النص الجديد منح رئيس المجلس التنفيذي لإمارة دبي صلاحية تمديد المُهلة المذكورة للمُدّة التي يُحدِّدها، في الأحوال التي تستدعي ذلك.

وحددت المادة رقم (9):

الجهة الحكومية التي تتولى توفير المُخصّصات الماليّة للجنة، حيث أوكلت هذه المادة لبلديّة دبي مهمة توفير المُخصّصات الماليّة اللازمة لتمكين اللجنة من تحقيق أهدافِها وإنجاز المهام المنوطة بها بمُوجب أحكام هذا القرار.

فيما تم تعديل المادة (10):

 من القرار الأصلي، والتي خوّلت رئيس المجلس التنفيذي لإمارة دبي صلاحية إصدار القرارات اللازمة لتنفيذ أحكام هذا القرار، ويعمل بهذا القرار من تاريخ صُدوره، ويُنشر في الجريدة الرسميّة.
